1. Eligibility and Acceptance

You must be at least 18 years old and legally able to enter into contracts to use our services. If you use our services on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

2. Athena Services

Athenaforme provides AI-assisted business communication, call-handling, lead qualification, scheduling, follow-up, automation, marketing-support, hosting, monitoring, and related business services.

Specific features, service levels, fees, setup requirements, and responsibilities may be described in an order, proposal, service agreement, or subscription plan. If a signed service agreement conflicts with these website Terms, the signed agreement controls for that service.

3. AI and Automated Services

Athena uses artificial intelligence and automated systems. AI-generated responses and automated actions may occasionally be incomplete, delayed, or inaccurate. Customers remain responsible for reviewing their business processes, instructions, calendars, service information, and outcomes.

Athena is not an emergency-response service and should not be used for emergency, medical, legal, financial, safety-critical, or other high-risk decisions without appropriate human review.

4. Accounts and Accurate Information

You agree to provide accurate and current information and to update it when necessary. You are responsible for protecting account credentials and promptly notifying us of suspected unauthorized access or misuse.

5. Acceptable Use

You may not use our website or services to:

• Violate any applicable law, regulation, or third-party right
• Send unlawful, deceptive, abusive, or unsolicited communications
• Misrepresent your identity, company, products, or services
• Upload malicious code or interfere with system security
• Attempt unauthorized access to accounts, systems, or information
• Collect or use personal information without appropriate authority
• Use Athena for unlawful discrimination, fraud, harassment, or harm
• Resell or copy services unless expressly authorized in writing

6. Customer Responsibilities

Customers are responsible for the accuracy and legality of information, scripts, contact lists, offers, instructions, and business rules supplied to Athenaforme. Customers must obtain all legally required permissions and consents before contacting people through automated calls, texts, email, or other communications.

7. Fees, Billing, and Subscriptions

Pricing, implementation fees, recurring charges, billing dates, cancellation terms, and included services are provided at purchase or in the applicable service agreement.

By purchasing a recurring service, you authorize the applicable recurring charges until the subscription is cancelled according to the governing service agreement. Taxes and third-party usage charges may apply where disclosed.

9. Intellectual Property

The Athena and Athenaforme names, website content, branding, software, workflows, designs, documentation, and related materials are owned by or licensed to Clark1financial AI Solutions, LLC and are protected by applicable intellectual-property laws.

We grant users a limited, revocable, nonexclusive, nontransferable right to access our website and authorized services for their intended business purposes.

10. Third-Party Services

Our services may integrate with third-party communications, scheduling, payment, hosting, analytics, social media, or software platforms. We do not control those services and are not responsible for their availability, policies, changes, or independent actions.

11. No Guarantee of Business Results

We work to improve responsiveness and business operations, but we do not guarantee any particular number of leads, appointments, customers, sales, revenue, savings, rankings, or other business results.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated in a signed agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that services will always be uninterrupted, error-free, completely secure, or compatible with every third-party system.

13. Limitation of Liability

To the fullest extent permitted by law, Clark1financial AI Solutions, LLC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost data, lost opportunities, or business interruption.

Any limitations contained in an applicable signed service agreement will also apply.

14. Suspension and Termination

We may restrict or suspend access when reasonably necessary to address security threats, suspected misuse, nonpayment, legal requirements, or violations of these Terms. Subscription termination and cancellation are also governed by the applicable service agreement.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute not governed by a separate written agreement will be brought in a court of competent jurisdiction in Virginia, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date. Continued use after an update constitutes acceptance of the revised Terms.
